We <br /> reverse . <br /> , FACTS . <br /> In September 1987 , respondenta Richard Stodola and Merrit <br /> Peterson bought a lor in the City of Orono from Ewald Gustafson for <br /> the purpose of building a dock, but noc a rasidence, on Lhe <br /> property. Glen Tillotson oGrned an adjoining lot that had a house <br /> on it. At the time of the purchaee, there waa an existing dock <br /> that had been constructed in 1960 . The exieting dock was believed <br /> ta be on Tillotson' 6 property, but it was later discovered it was <br /> on responden�s ' property. <br /> In a letter dated July 30, 1987 , Gustafson ' s attorney wrote <br /> P�teraon: ' <br /> This is to inform you that Mr. Gustaf son was told by <br /> a member of the staff of the city of Orono that it is <br /> necessary to own a home nearby in order to place a dock <br /> on a piece of property in Orono . We undcrstand Lhat you <br /> have made your own investigation and are willing to take <br /> your chances in convincing che city of Orono to grant you <br /> a vaziance. <br /> We just Want to be on record as not having made any <br /> guarantees in regard to the use of this property. Wou1d <br /> you kindly sign a copy of this letter so that we may have <br /> it in our files . <br /> Peterson signed the letter and dated it September 24 , 1987 . <br /> Respondents built a new dock in the spring of 1S8B . Shortly <br /> af ter they built it , the city "red-tagged" the dock, indicating <br /> that it was an illegal dock . The ciCy wrote to Peterson to inform <br /> hirn that the dock wae i.11egal . <br /> After meetings with city officials , respondents filed a <br /> variance appliention, eeeking "authority to construct boat dock on <br /> -2- <br />
