� o� <br /> � Fe O <br /> c���i�a:.- CITY of ORON <br /> � � ���� ti <br /> �L � `�.�p~' RESOLUTION OF T��I�Y�J.COUNCIL <br /> `9kESH04 NO. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants a <br /> variance to Orono Municipal Zonin� Code Section 78-350 to allow a lake setbacic of 58' where a <br /> 75' setback is required, a 10' side street setback where 15' is required, a rear yard setback of 10' <br /> wl�ere a 30' setback is required; and a variance to Orono Municipal Zonina Code Section 78- <br /> 1288 to allow 1,110 s.f. or 37.11% within the 0-75' setback area where Q% is normally allowed <br /> and 931 s.f. or 51.38% �vhere 25% is nornlally allowed in order to allow in constniction of a new <br /> single family home, subject to the following conditions: <br /> l. Council approval is based on the site plan and building plans submitted by the applica�zt <br /> aud amlotated by City staff, attached to this Resolution as Exhibit A. Any amendments <br /> to the site plan which are not in confoi-mity with City codes will require fiirther Planning <br /> Commission and City Council review. <br /> 2. Hardcover in the 0-75' zone shall not increase above the level of 1,110 s.f. or 37.11%. <br /> Hardcover in the 75-250' zone shall be limited to 931 s.f. or 51.38% per the proposed <br /> plan and hardcover allowance summary as depicted on Exhibit A. Applicant is advised <br /> that any fiiture requests to increase hardcover or change the nature of existing/approved <br /> hardcover shall require City approval, and increases in hardcover will not likely be <br /> approved without concu�Tent reduction in existing hardcover. <br /> 3. Applicant shall remove all plastic or fabric liner material from the decorative landscape <br /> beds on the property to ensure their permeability as non-hardcover surfaces. <br /> �. Required removals of structure and hard�over shall be completed by the footing <br /> inspection for the new home. <br /> �. Authorities granted by this resolution run with the property not with the applicant, but are <br /> pein�issive only and inust be exercised by obtaining a buildinQ peimit for the new <br /> construction �vithin one year of the date of Council approval, or the variance �vill eYpire <br /> on that date (September 25, 2007). <br /> 6. ��`iolation of or non-compliance ���ith any of the terms aiid conditions of this resolution <br /> shall constitute a violation of the zonin� code, shall automatically terminate any authority <br /> Uranted here;n. and shal? be p!1?11S��able as a r.�is��'I?�?3I?nr, . <br /> Pa�e 3 of� <br />
