The lot is significantly substandard in area and width and the existing <br /> sti-ucture and hardcover on the lot are nonconforming. The property is served <br /> ���ith municipal sewer. A residence has existed on the property for many <br /> years. <br /> b. There is no additional land available to brin� the lot �vidth or lot area into <br /> confonnity. <br /> c. The proposed stnicture complies with side yard and avera�e lakeshore setback <br /> requirements. <br /> d. A single family residence has existed on the property for many years. <br /> e. Because the property has less than 10,000 s.£ in area it is allowed a 1,500 s.f. <br /> structural footprint absent other factors. The applicant has proposed a 1,223 <br /> s.£ home. <br /> f. The applicant has proposed a minimal driveway, �valk, and patio in order to <br /> limit the magnitude of the hardcover excesses. <br /> g. The size of the proposed residence and magnitude of hardcover variance is <br /> consistent witl� other approved development in the neighborhood. <br /> 4. The City Council has considered this application including the findin�s and <br /> recommendation of the Plaiuzing Commission, reports by City staff, comments by <br /> the applicant and the public, and the effect of the proposed variance on the health, <br /> safety and welfare of the community. <br /> 5. The City Council finds that the conditions existin� on this property are peculiar to <br /> it and do not apply generally to other property in this zoning district; tllat granting <br /> the variance �vould not adversely affect traffic conditions, light, air nor pose a fire <br /> hazard or other danger to neighborin� property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate a demonstrable hardship <br /> or difficulty; is necessary to preserve a substantial property right of the applicant; <br /> and �vould be in keeping with the spirit and intent of the Zonin� Code and <br /> Comprehensive Plan of the City. y <br /> Pa�e ? of� <br />
