OF WEAR ENT&RPRYSES PARTNEItSHIP <br /> APPLICATION NO. 1169 <br /> : <br /> WH$R$AS, William Wear, an authorized agent of Wear Enterprises <br /> Partnership, (hereinafter "the applicant") filed a formal subdivision <br /> application with the City on June 25, 1987 for the purpose of platting 6 <br /> Iots of the property Iegally described as follows: <br /> The south 22 acres of the Southeast Quarter of the Southwest Quarter <br /> of Section 33, Township 118, Range 23, Hennepin County, Minnesota. <br /> EXCEPT the west 225 feet of the east 645 feet of the south 415.6 feet <br /> thereof (hereinafter "property"); and <br /> WH�R�AS, after due published and mailed notice in accordance with <br /> Minnesota Stat�ues 462.358 et. seq. and the City of Orono Zoning and <br /> • Subdivision Codes, the Orono Planning Commission held a public hearing on <br /> July 20, 1987 at which time aIl persons desiring to be heard concerning <br /> this application were given the opportunity to speak thereon; and <br /> WH�REAS, at their regular meeting held on November 9, 1987, the <br /> � Orono City Council considered the subdivision application of the applicant <br /> noting the following findings of fact: <br /> 1. The property is located within the RR-1B Single Family Rural <br /> Residential zoning district requiring a minimum of 2 acres of dry Iand <br /> within each newly created lot. <br /> 2. The property contains a total of 18.50 acres of dry contiguous <br /> land. � <br /> 3. AI1 six lots shall be served by a private raad for which the <br /> placement and curb cut have been approved by the City Engineer. <br /> � 4. A1 I lots meet the required 200 feet width adjacent to private road <br /> and at the front yard setback line. <br /> 5. A single family residence can be constructed on all proposed lots <br /> without the need for further variances. <br /> 6. Septic testing has confirmed that al 1 six lots contain adequate and <br /> � suitable soils for on-site sewage disposal systems. <br /> Page 1 of 3 <br />
