The lots were created in the early 50's prior to the City's <br /> adoption of ordinances that would have provided standards for the <br /> ' development of lots. <br /> • 9 . The applicants have owned the lots for approximately 30 years. <br /> 10. Lot 1 contains no accessory structures and would appear to serve <br /> merely as additional area receiving minimal maintenance. <br /> 11. Glenn Cook, the City Engineer, in a report dated October 6, 1987 <br /> states the following: <br /> Development of Lot 1 on Kelly Avenue will not result in any <br /> drainage problems for adjacent resident. <br /> The run-off from the neighborhood is currently directed to the <br /> City owned property South of Lot l. Development of this lot W�1 i <br /> result in additional run-off to the lake because of an increase <br /> in hardcover. We do not anticipate that this increase in run-off <br /> will cause any significant adverse effect on the lake. <br /> 12. The City Council has considered this application including <br /> reports by City staff, comments by the 'applicant and the effect of the, <br /> proposed variances on the health, safety and welfare of the community. <br /> 13. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to other <br /> property in this zoning district; that granting the variances would <br /> not adversely affect traffic conditions, Iight, air nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve <br /> • as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a <br /> substantial property right of the applicant; and would be in keeping <br /> with the spirit and intent of the Zoning Code and Comprehensive Plan <br /> of the City. � <br /> Page 2 of 5 <br />
