MINUTES OF THE ORONO PLANNING COMMISSION PUBLIC HEARING <br />• PROPOSED AMENDMENT TO SECTION 10.41, <br />B -2 LAKESHORE BUSINESS DISTRICT HELD ON JUNE 6, 1994 <br />Rowlette added that there may not be 100% agreement by everyone to the proposed amendment <br />but it is better than what existed. Changes can be made if necessary if there are parts that don't <br />work. <br />Smith asked what the next step would be. Gaffron responded that the draft ordinance would <br />likely be brought to Council in about three weeks, June 27, with the Planning Commission <br />recommendation for adoption. <br />Smith restated that the approach taken by the Planning Commission was to conceptually develop <br />a more workable ordinance by recognizing that the marinas are member of the community and <br />have certain responsibilities. By drafting the ordinance as the Planning Commission did, there <br />will be more give and take than in the past to work together with the marinas. Although some <br />new uses are proposed, there are some strings attached. <br />Gaffron reiterated that input had been received from the public and marina owners. Some <br />aspects of what the marinas do can make them a "bad neighbor" but generally they are not <br />problem neighbors. <br />Peterson added that there would always be problems when there is a business in a residential <br />• area. <br />Gaffron commented that providing marinas with more use options reflects what is happening <br />today and is a "trade off" for the marinas. The City should consider working with the marinas, <br />not against them, and assist them in being an amenity rather than trying to stop them from being <br />a problem. <br />Lindquist reiterated that the Planning Commission purposely decided to write the ordinance with <br />standards as they exist rather than changing it to meet the existing physical characteristics of the <br />marinas. <br />Mabusth stated that there were problems with some of the marinas as they exist because there <br />is a "grandfather" situation with some of the uses. <br />Gaffron thought additional language may be needed to address some of the existing uses that will <br />now become conditional uses. Gaffron will request that the City Attorney review the draft and <br />discuss the enforcement of conditional use permits for uses that already exist. Members <br />requested that they get copies of the Attorney's opinion before the Planning Commission meeting <br />of June 20 if possible so changes could be made at that meeting if they were necessary. <br />Beverly Blomberg, 3180 North Shore Drive, arrived late and commended the Planning <br />Commission for their well done work.
