MINUTES OF THE ORONO PLANNING COMMISSION MEETING <br />HELD AUGUST 15, 1994 <br />( #12) #1955 ANDREW J. MCDERMOTT III, 2702 WALTERS PORT LANE - <br />VARIANCE - PUBLIC HEARING - 10:12 TO 10:17 P.M. <br />The Affidavit of Publication and Certificate of Mailing were noted. <br />Andrew McDermott III was present. <br />Gaffron explained in May of 1991 applicant received approval for variances to construct a three - <br />season porch, bathroom addition and deck/walkway. At this time applicant is proposing to <br />construct a screen porch above a portion of the existing deck which would encroach into the <br />required 35' street yard by 1'. <br />Andrew McDermott stated the side deck along with other renovations to the house had been <br />done in 1983 which plans had been approved by the City at that time. Perhaps the City did not <br />realize it was 1' too close to the road. The improvement will not make it appear any closer to <br />the street yard. <br />Chair Schroeder asked whether there was public interest. There were no comments from the <br />public. <br />It was moved by Smith, seconded by Peterson, to recommend approval of Application #1955 <br />for Andrew J. McDermott III, 2702 Walters Port Lane, for the 1' variance as proposed. Ayes <br />4, nays 0. <br />( #13) #1956 TOM AND CHRIS SMIEJA, 4040 WATERTOWN ROAD - VARIANCES - <br />PUBLIC HEARING - 10:17 TO 10:30 P.M. <br />The Affidavit of Publication and Certificate of Mailing were noted. <br />Mr. and Mrs. Smieja were present. <br />Gaffron explained applicant proposes a 26'x48' addition to the east side and a 16'x14' addition <br />to the west side of the existing house. Because of the uniqueness of the lot, the additions require <br />a side street setback variance and a side setback variance. Orchard Park Road is considered the <br />front yard and Watertown Road is the side yard. The City Attorney is being consulted for a <br />clarification of the code which does not seem to fit Orono's rural character. The side street <br />setback requires 50' and proposed is at 45' and the existing is 42'. The required front setback <br />is 100' and 38' is being proposed for the principal structure and 25' for the three season porch. <br />No area variance is required. The additions do not change the size for septic use but the <br />0 existing and future septic area need to be protected. <br />13 <br />
