City Code 78-1279 regulates the placement of structures on <br /> properties within the City. On lakeshore properties no structure is allowed within 75' of <br /> the lake. New structures are not permitted within 75' of the lake. Further, City Code 78- <br /> 1288 prohibits hardcover within 75' of the lake; however a lake access stair is permitted. <br /> The City does not have a permit record for the original deck. Replacing the deck in-kind <br /> is allowed with a building permit. <br /> A survey dated, June 18, 2008 shows the deck 14' x 9' located approximately 8 feet from <br /> the southern, side property line. In a more recent survey dated November 12, 2009 the <br /> deck is now shown to be 22' x 12' spanning from property line to property line. The deck <br /> also appears to cross over the northern property line. <br /> This letter is your official notification that the deck is in violation of City Codes. The City <br /> requires that the deck be removed in order bring the property into compliance. If the <br /> deck is not removed or a complete after-the-fact variance application request submitted <br /> by January 20, 2010 this matter will be forwarded to our Attorney for legal action. A <br /> variance application is enclosed and a meeting with City staff is required prior to <br /> submittal. Please remove the deck or complete the application and schedule a meeting <br /> with me prior to January 9, 2010 to avoid legal action by the City. <br /> Your cooperation in this matter is appreciated.
