PILLSBIIRY - FILE #1008 <br /> WH$RSAS, the City of Orono is a municiapl corporation <br /> • organized and existing under the laws of the State of Minnesota; <br /> and • <br /> WHEREAS, the City Council of the City of Orono has <br /> adopted subdivision regulations for the orderly, economic and <br /> safe development of land within the City; and <br /> WHEREAS, the City Council has considered the <br /> , application for a Class I Subdivision by John S. Pillsbury, Jr. � <br /> (hereinafter "the subdivider") of a property legally described as <br /> follows: <br /> • . See Exhibit A Attached <br /> WHER$AS, the City Council grants variances to Section <br /> 10.02 items (39 ) , (43 ) , (67 ) , and (77 ) that require all lots to <br /> abut an existing or dedicated public street based on the <br /> following findings: <br /> l. The subject property cannot be put to a reasonable use <br /> � if used under the standards required by the above referenced <br /> sections of the code. <br /> 2. The plight of the landowner is due to circumstances <br /> unique to his property and not created by the landowner. <br /> 3. The granting of this variance will not alter the <br /> essential character of the surrounding neighborhood. <br /> • 4. The granting of this variance is in keeping with the <br /> intent of tYie Zoning Code and Comprehensive Guide Plan of <br /> the City. <br /> 5. The granting of this variance is consistant with the <br /> previous actions of the Counci 1 whenever it approves the� <br /> creation of lots served by private roads or private <br /> easements; and • <br /> • Page 1 of 2 <br />
