There is no additional land available to bring the lot width or lot area into <br /> confornlity. <br /> d. The proposed residence meets the structural lot covera�e limitation of 15%. <br /> e. The proposed residence complies with all lake yard, side yard, rear (street) <br /> yard, and avera�e lakeshore setback and hardcover requirements. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Plarnun� Commission, reports by City staff, comments by <br /> the applicants and �he public, and the effect of the proposed variance on the <br /> health, safety and welfare of the coinmunity. <br /> �. The City Council finds that the conditions existing on this property are peculiar to <br /> it and do not apply generally to other property in this zonin� district; that granting <br /> the variance would not adversely affect traffic conditions, light, air nor pose a fire <br /> hazard or other dan�er to nei�hboring property; would not inerely serve as a <br /> co�lvenience to the applicants, but is necessary to alleviate a demonstrable <br /> hardship or diffictilty; is necessary to preserve a substantial property right of the <br /> applicants; and would be in keeping with the spirit and intent of the Zoning Code <br /> and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants a <br /> variance to Orono Municipal Zoning Code Section 78-350 Subdivision B to allow <br /> redevelopment of a lot with �9 feet in width at the OHWL and 65 feet in width at the 75-foot <br /> setback from the OHWL where 100 feet in width is nonnallv required in order to construct a new <br /> residence, subject to tl�e following conditions: <br /> l. Council approval is based on the survey and building plans submitted by the applica�its <br /> and annotated by City staff, attached to this Resolution as E�:hibits A & B. Any <br /> ainendments to the site plan which are not in conformity with City codes will require <br /> further Planning Commission and City Counci] review. <br /> ?. Hardcover in the 0-75' zone shall not increase above the level of 128 s.f. or 2.5°/o. <br /> Hardcover in the 7�-250' zone shall be limited to 3,234 s.f. or 25%; hardcover within the <br /> 250'-�00' zone shall be limited to 3,807 s.f. or 30% per the proposed plan and hardcover <br /> allowance summary as depicted on Exhibit A.
