� o� <br /> 0 0 <br /> '�� - C ITY of ORQNO <br /> � _. <br /> � ��� � <br /> �� ���t, ~ G'�'� RESOLUTION OF THE.CITY OUNCIL <br /> ��kESH�4� N0. � � 6 � <br /> L The Applicant has demonstrated that enforcing the 75' to 250' zone hardcover <br /> and lot width provisions of the Zoning Ordinance deprive the Applicant of the <br /> reasonable use of their Property. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments by <br /> the Applicant and the public, and the effect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this Property are peculiar to <br /> it and do not apply jenerally to other property in this zoning district; that b anting <br /> the variance would not adversely affect traffic conditions, light, air nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the Applicant, but is necessary to alleviate a practical difficulty; is <br /> necessary to preserve a substantial property right of the Applicant; and would be <br /> in keepin� with the spirit and intent of the Zoning Code and Comprehensive Plan <br /> of the City. <br /> CONCLUSIOl�TS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants a <br /> variance to Orono Municipal Zoning Code Section 78-350(B) to allow construction of a new <br /> residence on an existing lot 60-feet in width at the OHWL and 65-feet in width at the 75-foot <br /> setback where 100-feet is required. The Orono City Council hereby grants a variance to Orono <br /> Municipal Zoning Code Section 78-1288 within the 75'-250' zone to allow 3,984 s.f. or 30.4% <br /> hardcover where 25% is normally allowed; and further denies a variance within the 250' — 500' <br /> zone to allow 4,798 square feet or 34.6% hardcover where 30% is normally allowed in <br /> conjunction with the construction of a new home and new detached �arage, subject to the <br /> followin� conditions: <br /> 1. Council approval is based on the survey and building plans submitted by the Applicant <br /> and annotated by City staff, attached to this Resolution as Exhibits A & B. Any <br /> amendments to the site plan which are not in conformity with City codes will require <br /> further Planning Commission and City Council review. <br /> 2. Hardcover shall not increase above the existing and approved levels as follows: 194 <br /> square feet of hardcover within the 0 to 75' zone; 3,984 square feet of hardcover within <br /> the 7�' to 2�0' zone; and 4,148 square feet of hardcover within the 250' to 500' zone. <br /> Page 3 of 5 <br />
