The City Council has considered this application including <br /> the findings and recommendations of the Planning Commission, <br /> reports by staff and comments of the applicant and the effect of <br /> the proposed use on the health, safety and welfare of the <br /> community. . . <br /> 5. The City Council finds that granting a Conditional Use Permit to <br /> allow the repair of a sea wall and permission to remove four mature <br /> trees within 75 feet of the lakeshore will not be detrimental to the <br /> health, 'safety or general welfare of the public, would not adversely <br /> affect light, air nor pose a fire hazard or other danger to <br /> neighboring properties, nor wil 1 it depreciate surrounding property <br /> values and that the proposed level of use of the property will be in <br /> keeping with the intent and objectives of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> • CONCLDSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above f indings, the Orono City Counci 1 <br /> hereby grants a Conditional Use Permit per Municipal Zoning Section 10.03, <br /> Subdivision 19 to permit the repair of a sea wall at 3115 North Shore Drive <br /> and per Section 10.22, Subdivision 3,approves the removal of four mature <br /> trees within 75 feet of the lakeshore, subject to the following conditions: <br /> 1. Dredged material to be removed from site. <br /> 2. Owner of property located at 3135 must plant three, three inch <br /> diameter trees within lakeshore yard by June 15, 1986 . <br /> 3. Applicants to obtain building permits for sea wall and permanent <br /> dock. <br /> 4. Erosion control to be provided at mouth of lagoon prior to repair <br /> of sea wall. <br /> 5. Violation of or non-compliance with any of the terms and - <br /> conditions of this resolution shall constitute a violation of the <br /> zoning .code, shall automatically terminate any authority granted here- <br /> in, and shal 1 be punishable as a misdemeanor. <br /> • 6. The undersigned applicant has read, understood and hereby agrees <br /> to the terms of this resolution and on behalf of himself, his heirs, <br /> successors and assigns, hereby agrees to the recording of this resolu- <br /> tion in the chain of title of the property. <br /> Page 2 of 4 <br />
