The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by staff and comments of the applicant and the effect of the proposed use on the health, safety and welfare of the community. . . 5. The City Council finds that granting a Conditional Use Permit to allow the repair of a sea wall and permission to remove four mature trees within 75 feet of the lakeshore will not be detrimental to the health, 'safety or general welfare of the public, would not adversely affect light, air nor pose a fire hazard or other danger to neighboring properties, nor wil 1 it depreciate surrounding property values and that the proposed level of use of the property will be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. • CONCLDSIONS, ORDER AND CONDITIONS Based upon one or more of the above f indings, the Orono City Counci 1 hereby grants a Conditional Use Permit per Municipal Zoning Section 10.03, Subdivision 19 to permit the repair of a sea wall at 3115 North Shore Drive and per Section 10.22, Subdivision 3,approves the removal of four mature trees within 75 feet of the lakeshore, subject to the following conditions: 1. Dredged material to be removed from site. 2. Owner of property located at 3135 must plant three, three inch diameter trees within lakeshore yard by June 15, 1986 . 3. Applicants to obtain building permits for sea wall and permanent dock. 4. Erosion control to be provided at mouth of lagoon prior to repair of sea wall. 5. Violation of or non-compliance with any of the terms and - conditions of this resolution shall constitute a violation of the zoning .code, shall automatically terminate any authority granted here- in, and shal 1 be punishable as a misdemeanor. • 6. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolu- tion in the chain of title of the property.
