A RESOLUTION GRANTING <br /> A CONDTIONAL IISE PERMIT <br /> PER MUNICIPAL ZONING CODE <br /> SECTION 10.03, SDBDIVISION 19 AND A <br /> PERMIT PER MDNICIPAL ZONING CODE <br /> SECTION 10.22, SIIBDIVISION 3 - <br /> FILE NO. 995 <br /> WHEREAS, Joe Durda and Joan J. Anthony (hereinafter "the <br /> applicants" ) are the respective owners of the properties located at 3135 <br /> and 3115 North Shore Drive within the City of Orono (hereinafter "City") <br /> and legally described as follows: <br /> 3135 North Shore Drive - Tract A RLS No. 1113 <br /> 3115 North Shore Drive - Tracts A&B RLS No. 269 <br /> (hereinafter "properties" ) and, <br /> WHEREAS, the applicants have applied to the City of Orono for <br /> a Conditiona 1 Use Permit to permit the repair of a sea wa 11 at 3115 North <br /> • Shore Drive per Municipal Zoning Code Section 10.03, Subdivision 19 and per <br /> Section 10.22, Subdivision 3 seeks permission to remove four mature trees <br /> within 75 feet of the lake at 3135 North Shore Drive. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of Orono, <br /> Minnesota: . <br /> FINDINGS � <br /> 1. This application was reviewed as Zoning File #995. <br /> 2. The property is located in the LR-1B Lakeshore Residential <br /> District. . <br /> 3. On December 16, 1985, the Orono Planning Commission reviewed <br /> the application as proposed and recommended approval based on the <br /> following findings: <br /> a ) The existing sea wall at 3115 North Shore Drive has <br /> deteriorated and poses a hazard to navigation and creates erosion <br /> problems. <br /> b) The trees were in a hazardous condition and posed a threat of <br /> damage to principal residence at 3135 North Shore Drive. <br /> • c) DNR and MCWD have approved the project. <br /> Page 1 of 4 <br />
