� V � � <br /> Cit� o� ORONO <br /> • Q� RESOLUTION OF THE CITY COUNCIL <br /> � NO. 1903 <br /> • � • • <br /> A RESOLIITION GRANTING <br /> VARIANCES TO <br /> MUNICIPAL ZONING CODE <br /> SECTIONS 10.22, SUBDIVISION 1 � 2, <br /> 10.25, SIIBDIVISION 6 (B) <br /> AND 10.55, SIIBDIVISION 8 <br /> FILE �983 _ <br /> WHEREAS, Mr. & Mrs. Walter Pemberton (hereinafter "the <br /> applicants" ) are the owners of the property located at 3580 North <br /> Shore Drive within the City of •Orono (hereinafter "City") and legally <br /> described as follows: <br /> Lot 7, Block 2, Baldur Park (hereinafter "property"); and <br /> WHEREAS, the applicants have applied to the City for a <br /> . variance to Municipal Zoning Code Sections 10.22, Subdivision 1 and <br /> • 10.55, Subdivision 8 to allow the construction of a single family <br /> residence located 52' from the shoreline where a 75' setback is <br /> normally required; a variance to Section 10.22, Subdivision 2 and <br /> 10.55, Subdivision 8 to allow hardcover in excess of the 0� normally <br /> allowed in the 0-75' lakeshore setback zone and in excess of the 25� <br /> ' normally allowed in the 75-250' lakeshore setback zone; and variances <br /> to Section 10.25, Subdivision 6 (B) to lot area (11,130 s.f. existing <br /> where 21,780- s.f. is normally required) , lot width (49.9' existing <br /> where 100' is normally required), side setback (5' proposed for tuck- <br /> under garage portion where 10' is normally required) , and street <br /> setback (28' proposed for house, 20' proposed for deck, where a 30' <br /> street yard setback is normally required). <br /> NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #983. <br /> 2. The property is located in the LR-1C Single Family Lakeshore <br /> Residential Zoning District. <br /> 3. The Orono Planning Commission reviewed this application on <br /> October 21, November 18, and December 16, 1985, and recommended <br /> approval of the proposed variances based upon the following <br /> • findings : <br /> A) The property is 49.9 feet in width and 11,130 square <br /> feet in area including the right-of-way of County Road 51. <br /> Page 1 of 5 <br />
