The dedication of roadway to the City creates a setback <br /> hardship on the front line of the property. <br /> 6. The property has been assessed for single sewer unit and <br /> f ootage charge in the amount of $2,18 6.5 0. The $2 2 5 plant . <br /> unit charge remains to be paid.. � <br /> 7 . The City Council has considered this application <br /> incl�:uing the findings and recommendations of the Planning <br /> � Commission, reports by City staff, comments by the applicant <br /> and the effect of the proposed variance on the health, safety <br /> and welfare of the community. . � <br /> 8 . The City Council finds that the conditions existing on <br /> this property are pec�tliar to it and do not apply generally to <br /> other property in this zoning district; that granting the <br /> " variance would not adversely affect traffic� conditions, <br /> light, air nor pose a fire hazard or other danger to <br /> - neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate a <br /> � demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the applicant; and <br /> would be in keeping with the spirit and intent of the Zoning <br /> . Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS , <br /> Based upon the above findings, the Orono City Council hereby <br /> � grants a variance to the . Municipal Zoning Code Section 10 .24, <br /> Subdivision 5 (B) to permit the construction of a new residence on a lot <br /> of 31,200 square feet in area instead of the required 43,560 square <br /> feet, and to approve a side street setback of lE; feet where 35 feet is <br /> required, and approve a front setback •of 26 feet from the dedicated <br /> right-of-way where 35 feet is required, subject to the following <br /> conditions: . <br /> 1. Applicant must dedicate by quit claim deed additional <br /> right-of-way including portions of the shoulder, on the <br /> north side of the p,roperty along and over the travelled <br /> portions of "Lafayette Avenue" . <br /> 2. Applicant must grant a utility easement surrounding the <br /> existing manhole and sewer lines at the southeast corner of <br /> the property. <br /> 3. Applicant to pay sewer plant unit charge of $225 and � <br /> OSewer Availability Charge (SAC) of $425 to be collected when <br /> a Building Permit is issued. <br /> , page 2 of 4 , <br />
