Howells (hereinafter "the applicant" ) is <br /> owner of the property located at 1448 Park Drive within the City of <br /> Orono (hereinafter "City" ) and legally described as follows: <br /> . Saga Hill Park, in °Saga Hill Revised, Hennepin County, <br /> Minnesota° (hereinafter "property" ) , and ' <br /> WHEREAS, the applicant has applied to the City for a variance <br /> to Municipal Zoning Code Section 10.24, Subdivision5 (B) to permit the <br /> . construction of a residence on a lot of 31,200 square feet in area <br /> instead of the required 43 ,560 square feet; and to approve a side street • <br /> setback of 16: feet where 35 feet is required and approve a front setback <br /> of 26 feet from the dedicated right-of-way where 35 feet is required. <br /> NOW; THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: � � . <br /> • FINDINGS <br /> l . This application was � reviewed, as zoning file #858. <br /> 2. The property is located in the LR-1B Single Family <br /> Lakeshore Residential Zoning District. . <br /> 3. The original platted area of "Saga Hill Park" was 0.80 � <br /> � acres. Dedication of County Road 19 right-of-way reduced <br /> the area to 0.72 acres. The further dedication of roadway to <br /> • the City of Orono will reduce the lot area to approximately <br /> 0 .6 acres. <br /> 4. The Orono Planning Commission reviewed thisapplication <br /> on September 17 , 1984, and recommended approval of the <br /> � proposed lot area variance based upon the following <br /> findings: <br /> • a) The property is severely restricted due to <br /> surrounding roadways. <br /> b) No other land is available to be combined with <br /> the property. • . <br /> � c) The location of three mature maple trees on the <br /> property and the locations of existing lot boundaries in <br /> relation to the existing traveled roadsmay require that <br /> a setback variance is needed from the east lot line. <br /> d) The existing cabin is a legal non-conforming <br /> . structure and is subject to pertinent ordinances. <br /> � page 1 of 4 <br />
