RESOLUTION OF THE CITY COUNCIL <br />NO. <br />5672 <br />A RESOLUTION APPROVING <br />AMENDMENT #4 OF THE <br />2000-2020 CITY OF ORONO <br />COMMUNITY MANAGEMENT PLAN <br />WHEREAS, the City of Orono is a municipal corporation located within <br />Hennepin County and within the planning jurisdiction of the Metropolitan Council; and <br />WHEREAS, in accordance with the Metropolitan Land Planning Act of 1976 and <br />its amendments, and with Minnesota Statutes Chapters 462 and 473, the City of Orono in <br />November 2001 adopted a comprehensive municipal plan known as the 2000-2020 City of <br />Orono Community Management Plan (also referred to as the 2000-2020 CMP) to provide for the <br />orderly development of the City; and <br />WHEREAS, an integral element of the 2000-2020 CMP is the Comprehensive <br />Sewer Policy Plan, which identifies certain areas of the City as being within the Metropolitan <br />Urban Service Area (MUSA) in which connections to the metropolitan sanitary sewer system are <br />allowed; and <br />WHEREAS, the property at 25 Brown Road South within the City of Orono <br />contains a single family residence constructed in approximately 1940 and is approximately 3.0 <br />acres in area, of which approximately 1.5 acres is disturbed soil unsuitable for septic system use. <br />The property is zoned RR -1 B 2 -acre minimum and currently has a failing septic system; and <br />WHEREAS, when the Fox Ridge pressure sewer project was installed in 1999 <br />the property owners along the west side of Brown Road were offered the opportunity to connect <br />to the sewer. The owners of 5 and 15 Brown Road South requested inclusion; the then owner of <br />25 Brown Road South declined, since at that time the septic system was not failing. The <br />properties at 5 and 15 Brown were added to the MUSA in 2000. Since then the property at 25 <br />Brown Road has changed hands and the septic system has failed. The new owner requested <br />sewer in 2005, which resulted in this amendment; and <br />WHEREAS, the property has limited available area for septic system <br />replacement or expansion; and <br />WHEREAS, in light of the above noted facts the Orono Planning Commission <br />pursuant to published and written notice to the affected and surrounding property owners held a <br />Pagel of 3 <br />
