CITY ®f ORONO <br />j RESOLUTION OF THE CITY COUNCIL <br />NO. 5624 <br />FINDINGS <br />1. This application was reviewed as Zoning File 07-3283. <br />2. The property is located in the LR — 113, Lakeshore Zoning District which <br />requires a minimum lot area of 1.0 dry acres and a minimum lot width of <br />140' feet. <br />3. The Planning Commission reviewed this application at a public hearing <br />held on April 16, 2007 and recommended approval of the hardcover <br />variance and conditional use permit based on the following findings: <br />a. Other than the average lakeshore setback, the proposed addition and <br />home will meet the Zoning Ordinance requirements with respect to <br />setbacks, lot coverage by structures, and building height. <br />b. The retaining walls and addition will have no negative impacts to <br />views of the Property as viewed from the lake. <br />c. No neighbor's views of the lake will be affected as a result of the <br />average setback variance. <br />d. Replacement and reconfiguration of the retaining walls is necessary to <br />allow for adequate pedestrian access to the residence. <br />4. The City Council has considered this application including the findings <br />and recommendation of the Planning Commission, reports by City staff, <br />comments by the applicants and the public, and the effect of the proposed . <br />variance and conditional use permit on the health, safety and welfare of <br />the community. <br />5. The City Council finds that the conditions existing on this property are <br />peculiar to it and do not apply generally to other property in this zoning <br />district; that granting the variance and conditional use permit would not <br />adversely affect traffic conditions, light, air nor pose a fire hazard or other <br />danger to neighboring property; would not merely serve as a convenience <br />to the applicants, but is necessary to alleviate a demonstrable hardship or <br />diffi/_.111ty; is necessary to prP.gerve a m hstantlal property right of the <br />Page 2 of 5 <br />
