. ,
. .
eo.iii. )
-:Aa. k..._ CITY of ORONO
7\' ,,<-4'1,0t.
,
Aii,01hk RESOLUTION OF THE CITY COUNCIL
` ICESIID4 NO. 5 6 0 5
FINDINGS
1. This application was reviewed as Zoning File#07-3255.
2. The property is located in the LR-1C zoning district, where 0.5 acre is the
minimum lot area and 100 feet is the minimum lot width. The property is
approximately .39 acre in area and 80 feet in width.
3. The Planning Commission reviewed this application on March 19, 2007 and on
a vote of 7 - 0 recommended approval of the variances, based on the following
findings:
a. The location of the house and the topography of the rear yard would make
it very difficult to locate a garage at the required setback. -
b. While the property to the west of this property is a street right of way it is
very unlikely that it will ever be used for a road. It may be used for a trail.
Impact of the garage on trail users would not be much different from a
privacy fence the Owner could erect along the lot line in this area.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments
by the applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variances would not adversely affect traffic conditions, light, air
nor pose a fire hazard or other danger to neighboring property; would not
merely serve as a convenience to the Owner but necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the applicants; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
