/o 0 <br /> = ; �� CITY of ORONO <br /> P;1$4. �� � �'et <br /> Ar <br /> �, : lio'� G~ RESOLUTION OF THE CITY COUNCIL <br /> `9kEST30- NO. 5 b Q 5 <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTIONS 78-1288 AND 78-350 <br /> FILE NO. 07-3255 <br /> WHEREAS, Catherine L. Sweet, a single person, (hereinafter "Owner") is <br /> the owner of the property located at 3405 Crystal Bay Road within the City of Orono <br /> (hereinafter "City") and legally described as: All of Lot 19 save and excepting West 20 feet of <br /> said Lot 19 and running from the North to South line of said Lot 19 heretofore taken for street <br /> purposes. Also a strip of land 20 feet wide formerly lying between Lots 18 and 19 and used <br /> for street purposes which said street has been vacated and said strip of land has by Decree of <br /> District Court, Hennepin County, declared to be part of said Lot 19. Also a part of Lot 18 <br /> beginning at the Northwest corner of said Lot 18, thence easterly 10 feet, thence South to rear <br /> line of said Lot 18, thence West 10 feet to Southwest corner of said Lot 18, thence North to <br /> point of beginning. All in Wallaces Addition to the Village of Minnetonka Beach, Hennepin <br /> County, Minnesota, according to the plat thereof on file and of record in the office of the <br /> Register of Deeds within and for said County(hereinafter "the Property"); and <br /> WHEREAS, the Owner has made application to the City for a variance to <br /> Municipal Zoning Code Section 78-1288 to allow 1.97 percent hardcover in the 0 to 75 foot <br /> zone when no hardcover is allowed and 32.7 percent hardcover in the 75 to 250 foot zone <br /> when the maximum is 25 percent; and <br /> WHEREAS, the Owner has made application to the City for a variance to <br /> Municipal Zoning Code Section 78-350 to allow a garage five feet from the westerly property <br /> line when a 15 foot setback is required; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on March 19, 2007, at which times all persons desiring to <br /> be heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> Page 1 of 5 <br />
