CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />651 <br />C� <br />ti' O . <br />WHEREAS, after due published notice and mailed notice in accordance with Minnesota <br />Statutes and the Orono, City Code, the Orono Planning Commission held a public hearing on <br />January 19, 2016, at which times all persons desiring to be heard concerning this applications were <br />given the opportunity to speak thereon; and <br />WHEREAS, on January 19, 2016 the Planning Commission voted 6-0 to approve the <br />applications; and <br />WHEREAS, the Orono City Council reviewed the application and accepted additional <br />comments by the applicants and the public at its regular meeting held on February 8, 2016; and <br />WHEREAS, the City Council has reviewed the applications; the findings and <br />recommendations of the Planning Commission; reports by City staff; and the comments submitted <br />by the applicants as well as those received from members of the public. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby denies the requested rezoning and Conditional Use Permit to allow the development of a <br />Nursing Facility (Comprehensive Care Facility) based on one or more of the following findings of <br />fact concerning the Property: <br />1. The analysis contained within staff memos dated January 19, 2016 and February 8, 2016; <br />and the exhibits attached to the aforesaid memos, all minutes from these meetings; and any <br />and all other materials distributed at these meetings are hereby incorporated by reference. <br />2. The Property is located in an area where the City, through the current zoning, is trying to <br />promote traditional retail operations rather than office and other professional businesses. <br />3. The B-5 zoning district is intended to provide opportunity for businesses that supply <br />commodities or perform a service primarily for residents in the surrounding neighborhood. <br />The proposed use is more regional in nature. <br />4. The B-4 zoning district is intended for office and professional businesses, primarily <br />administrative offices, with limited contact with the public. The Property is located in a <br />high visibility, high traffic area best suited to convenience retail, not destination businesses. <br />The proposed use is considered by the Council a destination business. <br />5.
