The Planning Commission reviewed this application on May 18, 2009 and on a <br /> vote of 7 - 0 recommended approval of setback variances to allow a 25 foot <br /> deep by 30 foot wide garage placed so the south wall of the garage is in a line <br /> with the north wall of the house (approximately 5.8 feet from the north <br /> property line) and so the southeast corner of the garage is 10 feet from the <br /> northwest corner of the house (approximately eight feet from the right of way <br /> of Arbor Street). This recommendation is based on the following findings: <br /> a. It is a hardship to not have a garage. <br /> b. A �arage of the size proposed is necessary to accommodate vehicles as <br /> we11 as the equipment necessary to maintain the property. <br /> c. The proposed design and approved location is compatible with the <br /> surrounding area. There are detached garages across the street that are <br /> located very close to the right of way. The adjacent house to the north is <br /> located only 24 feet from the right of way. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments <br /> by the applicants and the public, and the effect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> 5. Notwithstanding the recommendation of the Planning Commission the City <br /> Council finds that a 26 foot deep garage is necessary to accommodate vehicles <br /> and maintenance equipment and that the topography of the lot makes it <br /> unreasonable to place the garage any farther than two feet from Arbor Street. <br /> 6. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances would not adversely affect traffic conditions, light, air <br /> nor pose a fire hazard or other danger to neighboring property; would not <br /> merely serve as a convenience to the Owners but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the Owners; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> Page 2 of 4 <br />
