� <br /> o.�,. <br /> o ,� o <br /> �a_ CITY of 4RON0 <br /> � � <br /> � ::�-.. � <br /> RESOLUTION OF THE CITY COUNCIL <br /> ���kES�I�g'�G NO. 5 g � 6 <br /> A RESOLUTION <br /> GRANTING VARIANCES <br /> TO THE ORONO, MINNESOTA, CITY CODE <br /> SECTIONS 78-420, 78-1403, AND 78-1436 <br /> FILE NO. 09-3402 <br /> WHEREAS, Philip Frank Kale3� and Lorraine Adele Kaley, husband and <br /> wife, (hereinafter "Owners") are the owners of the property located at 1395 Brown Road <br /> South ��ithin the City of Orono (hereinafter "City") and legally described as: Lot 5, Block l, <br /> Markville, Hennepin County, Minnesota(hereinafter "the Property"); and <br /> WHEREAS, the Owners have made application to the City for a variance to <br /> Orono Code Section 78-420 to allow a detached garage less than 30 feet from the right of way <br /> of Arbor Street; and <br /> WHEREAS, the Owners have made application to the City for a variance to <br /> Orono Code Section 78-1403 to allow structural coverage in excess of 15 percent; and <br /> WHEREAS, the Owners have made application to the City for a variance to <br /> Orono Code Section 78-1436 to allow a detached garage less than 15 feet from the north <br /> property line; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission <br /> held a public hearing on May 18, 2009, at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> NO�', THEREFORE, BE IT RESOL��ED by the City Council of Orono, <br /> Minneso�a: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#09-3402. <br /> 2. The Property is located in the RR-1B zonin� district, where 2 acres is the <br /> minimum lot area and 200 feet is the minimum lot width. The Property is <br /> approximately 0.37 acre in area and 76.89 feet in width. <br /> Page 1 of 4 <br />
