The City Council has considered this application includin� the findings <br /> and recominendation of the Planning Commission, reports by City staff, <br /> comments by the applicants and tl�e public, and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> 7. The City Council finds that the conditions existin� on this property are <br /> peculiar to it and do not apply generally to other property in this zoning <br /> district; that granting the variance would not adversely affect traffic <br /> conditions, light, air nor pose a fire hazard or other danger to nei�hbaring <br /> property; would not merely seive as a convenience to the applicants, but is <br /> necessary to alleviate a demonstrable hardship or diff culty; is necessary to <br /> preserve a substantial property right of the applicants; and would be in <br /> iceeping with the spirit and intent of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> CONCLtiS�ONS, OI�3E1�AND CONI)�'I'IONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a variance to Orono Municipal ZoninJ Code Sections 78-1279(1) and 78-1288(A) <br /> & (B) to allow hardcover at 18% or 2,794 s.f. within the 0-75' zone and hardcover at <br /> 21% or 5,1?9 s.f. within the 75'-250' zone in conjunction with construction of a 233 s.f. <br /> attached �ara�e addition and 2pd story bathroom �vindow dormer, subject to the follo�vin� <br /> conditions: <br /> 1. Council approval is based on the site plan submitted by the applicants and <br /> annotated by City siaff, attached to tl�is Resolution as E�hibit A. Airy <br /> amendments to the site plan tivhich are not in confoi7nity with City codes �vill <br /> require filrther Plam�ing Colnnlission and Citv Council revie«-. <br /> ?. Hardcover i�l the 0-75' zone shall not increase above the level of 2,794 s.f. or <br /> 13°io.
