(2) Interfering with, obstructin�or rendering dangerous for passage any street,public
<br /> right-of-way or waters used by the public; or
<br /> a. Lighting that is aimed or directed to create glare within any street.
<br /> (3) Any other act or omission declared by law to be a public nuisance.
<br /> (b) It is unlawful for any person to permit real property under his control to be used to
<br /> maintain a public nuisance, or let the property to another knowing it is to be so used.
<br /> SECTION 3. Division 6 Performance standards, Section 78-1583 Glare or heat of
<br /> the City of Orono Municipal Code is hereby amended by striking and adding the following
<br /> text:
<br /> Sec. 78-1573.— Lightin�.

<br /> �a General provision. An��ting used to illuminate a structure, an off-street parking area,
<br /> or other area in any residential zonin� district shall be arranged so as to deflect li =h�, t away
<br /> from anv adjoinin�residential property or from anypublic ri�;ht-of-wa .�ghtin� shall be
<br /> installed in accordance with the following�rovisions:
<br /> �1)LiQhtin�adLacent propertv. Li h�ting sources shall not be permitted so as to li�
<br /> adjacent propertv in excess of the maximum intensity_
<br /> (2) Maximum Intensity. No light source or combination thereof which casts li ng t on a
<br /> public street shall exceed one foot-candle (meter reading) as measured from the ri�ht-of-
<br /> way of said street nor shall any li�ht source or combination thereof which casts li h�
<br /> adjacent residential property exceed four-tenths (0.4) foot candles (ineter reading) as
<br /> measured at the pro�erty line.
<br /> (3)Architectural/historical li,�ht fixtures. Architectural/historical li�ht fixtures that
<br /> feature �lobes that are not shielded mav be approved by the Citv Administrator or
<br /> designee. In no case shall the light affect adjacent property in excess of the maximum
<br /> intensitv.
<br /> (4) Shieldin�. Outdoor light fixtures, when placed within the lake yard, shall be fully
<br /> shielded.
<br /> SECTION 4. EFFECTNE DATE: This ordinance shall take effect immediately upon
<br /> its passage and publication.
