ORDINANCE NO. , THIRD SERIES <br /> CITY OF ORONO <br /> HENNEPIN COUNTY, MINNESOTA <br /> AN ORDINANCE AMENDING THE ORONO MUNICIPAL CODE <br /> BY AMENDING SECTIONS 78-1, 70-4, and 78-1573 <br /> REGARDING LNING WALLS IN THE LAKE YARD AND LIGHTING IN <br /> RESIDENTIAL ZONING DISTRICTS <br /> THE CITY COUNCIL OF ORONO ORDAINS: <br /> SECTION 1. Section 78-1 Definitions of the City of Orono Municipal Code is <br /> hereby amended by adding the following text: <br /> "Fully shielded luminaire means a li�ht fixture constructed and installed in such a manner that <br /> all li�ht einitted bv the fixture, either directly from the lamp or a diffusing element, or indirectly <br /> by reflection or refraction from anv part of the fixture, is projected below the horizontal plane <br /> through the fixture's lowest li�ht-einittin�part. Light emittin�part, for the purposes of this <br /> section, mav include bulb, diode, or tube." <br /> "Glare means the sensation produced bv one or more luminaires within the visual field that are <br /> sufficientl�greater than the luminance to which the eyes are adapted, which causes annovance, <br /> discomfort, or loss in visual performance and visibilit� <br /> "Living Wall means a combination of three or more evergreen plants that are 6ft or inore in <br /> hei ng t and planted in such a manner that their spacing is equal to the width of the plant." <br /> SECTION 2. Section 70-4 Public Nuisance of the City of Orono Municipal Code is <br /> hereby amended by adding the following text" <br /> (a) It is unlawful for any person to maintain a public nuisance by his act or failure to perform a <br /> legal duty. For purposes of this section, a public nuisance shall be defined as any of the <br /> following: <br /> (1) Maintaining ar permitting a condition which unreasonably annoys, injures or <br /> endangers the safety, health, morals, comfort or repose of any considerable number of <br /> members of the public, includin�, but not limited to: <br /> a. Li htin�which casts light on adjacent residential propertv that exceed one (1.0) foot <br /> candle�meter reading) as measured at thepropertv line. Publiclv owned or controlled <br /> li�ht fixtures are exempt from this provision. <br /> b. The maintenance of a living wall within the average lake shore setback as it applies <br /> to fences; <br /> Page 1 of 3 <br />
