preclude, the use, improvement and development, under the conditions and covenants contained <br /> in this Section 3.5, of the Preservation Easement Areas. <br /> In fiutherance of such easement, Developer, for itself and a11 future 4wners of each of <br /> the Lots, hereby covenants and agtees that, except as expressly permitted by this Section 3.5: (a) <br /> no structure shall be constructed, erected or placed upon the Preservation Easement Areas, <br /> including without limitation fences, fireplaces, steps, hardcover or roads of any nature <br /> whatsoever, or any other structure or improvement inconsistent with the natural state of the <br /> Preservation Easement Areas, except that walldng paths that are not made of hardcover sha11 be <br /> pennitted with approval of the Committee; (b} no domestic animals shall be kept or allowed to <br /> remain within the Preservation Easement Areas; (c) no tree, shrub or other vegetation within the <br /> Preservation Easement Areas shall be destroyed, cut or removed except as authorized in writing <br /> by the Association and in accordance arith an approved vegetation management plan; (d} no <br /> earth, loam, peat, gravel, soil or any other natural maxerial or substance sha11 be moved or <br /> removed from the Preservation Easement Areas, nor shall any dredging or excavation of any <br /> nature whatsoever in, or any change in the topography of, the Preservation Easement Areas be <br /> made without the written consent of the Association; (e) no soil, saud, gravel or other substance <br /> or material as landfill sha11 be placed, durnped or stored in, and no waste, trash or garbage shall <br /> be dumped or stored in, the Preservation Easement Areas; (� no use of the Preservation <br /> Easement Areas shall be made except any uses which will not change or alter the naturai <br /> condition of the Preservation Easement Areas, and no use which would tend to change the <br /> drain�ge, flood control, water conservation, erosion control, soil conservation, wildlife habitat <br /> characteristics and scenic views of the Preservation Easement Areas sha11 be made; and (g} the <br /> City and the Association may enter upon the Preservation Easement Areas for the purpose of <br /> 9 <br />
