The applicants have provided a list of proposed definitions for consideration <br /> tonight. <br /> Barnhart stated the danger in being overly restrictive in defining a use is that if a use does not meet the <br /> restrictions laid out in the definition,the use is not allowed even though it may be appropriate. <br /> Consequently, Staff has drafted a second ordinance that allows kennels and dog grooming as a conditional <br /> use in the B-1 zoning district and defines those since neither of those uses are defined. <br /> The Planning Commission has three options: One, they can support the ordinance amendment as <br /> proposed by the applicants, which is the more narrowly defined dog grooming, dog boarding and dog <br /> care,and allow those as a conditional use in the B-1; two,the Planning Commission can support the more <br /> general one suggested by Staff; or three,the Planning Commission can recommend denial and make no <br /> changes to the B-1 zoning district. <br /> In a review of the request, Staff felt it was consistent of the B-1 zoning district. Barnhart noted pet shops <br /> are allowed or located in the B-1 zoning district and that type of use may sell animals. <br /> Berg stated to her knowledge there was a dog grooming business in Navarre years ago,which has since <br /> relocated to Mound. Berg asked if that was approved or whether it was just there. <br /> Barnhart indicated he is not aware of any other businesses to this being in the B-1 zoning district. <br /> Landgraver asked whether the pets would stay overnight in that situation. <br /> Berg indicated they would not. <br /> Leskinen noted with a pet shop the animals would be there overnight. <br /> Thiesse noted a pet shop would typically have smaller animals. <br /> Landgraver asked if a kennel is defined as three or more dogs. <br /> Barnhart stated that is correct. <br /> Landgraver noted the ordinance says four or more and that the City should maybe be consistent with dog <br /> kennel licenses. <br /> Barnhart stated Staff chose four because it would allow a distinction between dog kennels and this type of <br /> business being proposed. <br /> Landgraver asked if the City notified the public of this proposed ordinance change other than the standard <br /> 350 feet. <br /> Barnhart indicated Staff did not because it would impact more than five acres. <br /> Leskinen asked if there is a capacity limit. <br /> Page 10 of 43 <br />
