Granting of the standard drainage and utility easements <br /> along lot lines . <br /> 6 . Payment of the standard park fee less the value of said <br /> trail easement, in the amount of $2, 596 . <br /> 7 . Payment to the City of final plat fees in the amount of <br /> $200 . <br /> NOW, THEREFORE BE IT RESOLVED, that the City Council of <br />' the City of Orono hereby approves the plat of Bayside Landing <br /> Second Addition, Hennepin County, Minnesota, subject to the <br /> following conditions : <br /> 1 . Lot 1 shall gain access via Landmark Drive and shall <br /> remain subject to the covenants and obligations associated <br /> with that private road. The existing driveway access from Lot <br /> • 1 onto Bayside Road shall be regraded to the satisfaction of <br /> the City to eliminate all future access at that location <br /> before a building permit will be issued for Lot 1. Lot 2 <br /> shall gain access to County Road 84 subject to the conditions <br /> of the approved Hennepin County driveway access permit on <br /> file. <br /> 2 . Lot 1 is granted lakeshore access via Outlot A of Bayside <br /> Landing and shall be subject to the existing Declaration of <br /> Covenants, Conditions and Restrictions (Document No. 1951786) , <br /> the existing Declaration of Private Road and Utilities <br /> Easement and Covenant for Road Maintenance (Document No. <br /> 1951785) , and the Special Lot Combination (Document Nos . <br /> 1951787 and 1999151) . Lot 2 shall have no lake access via <br /> Outlot A. <br /> 3 . The existing building foundations on Lot 1 shall be <br /> removed within 6 months of the date of final plat approval, or <br /> prior to issuance of a Certificate of Occupancy for a new <br /> residence on Lot 1, whichever comes first . <br /> 4 . All construction shall be within the building envelope <br /> defined on the preliminary plat drawing dated 8-28-92/revised <br /> 10-8-92 . <br /> • Page 2 of 3 <br />
