Development agreement and letter of credit will be required. <br /> <br />Gaffron noted also received late today was a letter from Mark Gronberg, a letter from Bruce Markelson, <br />and one additional condition proposed by the developer. Staff recommends approval of the resolution. <br /> <br />Levang asked if the developer has proposed the additional condition. <br /> <br />Gaffron indicated that is correct. <br /> <br />McMillan asked if there will be three or four outlots. <br /> <br />Gaffron stated the developer is proposing three, but all four lots will have access and abut Tanager Lake. <br />At this point only the large parcel has shoreline along Smiths Bay. Gaffron stated the question is whether <br />it is reasonable to split it into three separate outlots so each of the three new lots that abut Tanager Lake <br />will have the potential opportunity for a dock. <br /> <br />McMillan asked if the main house would have access. <br /> <br />Gaffron stated it would not. <br /> <br />Michael Steadman, Development Consultant, stated he and his development team have read the staff <br />report, the proposed resolution, and the memo from the consulting engineer, and the comments from the <br />public made at the last Council meeting. Steadman indicated he will ask Mark Gronberg to specifically <br />address the memo written by Mr. Erickson and how the issues raised are inaccurate and incorrect. <br />Steadman stated the City Council also received a letter from Mr. Gronberg last Friday. <br /> <br />Steadman noted Mr. Gronberg has been involved in 100 subdivisions in Orono and works well with Staff <br />in following the process for preliminary and final plat phases of the approval process. Steadman stated he <br />had several meetings with Staff months before submitting the application and that they knew the <br />expectations of the City ahead of time as to what was required to move forward. Steadman stated he is <br />not sure how may meetings Mr. Erickson has had with Staff, if any, regarding this proposed subdivision <br />in order to support his claims of an incomplete application. Steadman stated he is sure Staff would have <br />shared with him the long-established process and protocols. Steadman stated if Mr. Erickson had met <br />with Staff, he would not have made most, if not all, of his comments in his memo and in his statements to <br />the Council at the last Council meeting. <br /> <br />Steadman noted they were not present at the last Council meeting but that he has read the minutes from <br />that meeting. Steadman stated there was also a statement by a person in the neighborhood that they have <br />been misleading and giving inaccurate information, which is just flat out wrong. Steadman stated that <br />would be unethical conduct and they do not conduct themselves that way. Mr. Steadman stated as has <br />been addressed in the past Council meetings, they have gone above and beyond the normal requirements <br />to accommodate the neighborhood with procedures and ideas to help lessen and eliminate the possible <br />and unsubstantiated inconvenience and stated concerns about future construction traffic. <br /> <br />Mr. Steadman stated they have been transparent from the beginning regarding their information and have <br />not objected to those who have walked the property without permission. In addition, information has <br />been supplied from several experienced engineers, contractors, custom home builders, and recently a <br />letter from the Fire Chief on how any temporary road up and down a steep slope is simply unsafe,
