The justification for approval of <br />this variance is included in the findings section of the preliminary plat resolution. It should also be noted <br />that a private road from Shoreline Drive ending in a cul-de-sac to serve the three lots would have to be at <br />least 1,750 feet in length, which is longer than the extended Heritage Lane at 1,600 feet. <br /> <br />The resolution includes the following key elements: <br /> <br />1. Physical characteristics of the property and the proposed development are documented; <br /> <br />2. It is noted that a variance for road length is intended to be granted and justification for the <br /> variance provided; <br /> <br />3. Concerns of the Foxhill residents are noted in the “Findings” and the Developer’s remedies for <br /> addressing those concerns are noted in the Conclusions, Order and Conditions; <br /> <br />4. The Conservation Design inventory and Master Plan are summarized, with the condition that the <br /> Conservation Design recommendations be adhered to; <br /> <br />5. Provision of municipal sewer to the property is discussed; a sewer connection charge of $89,760 <br /> is established based on the 1998 Shoreline/Heritage sewer project per the 2015 Fee Schedule – <br /> this includes connection of the three new homes plus the exiting main residence at 1700 Shoreline <br /> Drive. <br /> <br />6. It is noted that Lots 1 and 2 will have new existing grades established for height and story <br /> determination purposes; <br /> <br />7. The three outlots along Shoreline Drive intended as future potential dockage for Lots 1 through 3 <br /> are discussed, noting that this plat approval does not approve use of those outlots for dockage, but <br /> requires separate City and MCWD review and approval. <br /> <br />8. The standard easements for wetland protection are required; the small wetland being filled for the <br /> road extension technically requires approval by MCWD, is not expected to require mitigation <br /> under the deminimus rules, and under Orono Code is required to be removed from the Wetland <br /> Overlay District. This process would occur as part of final plat approval; <br /> <br />9. Removal of the existing cul-de-sac wings is to be decided prior to final plat approval; <br /> <br />10. Minnehaha Creek Watershed approval of the stormwater management plan and facilities will be <br /> addressed and adhered to; <br /> <br />11. Recommendations of the City Engineer regarding stormwater management and other topics shall <br /> be addressed and adhered to; <br /> <br />12. Park fee of $16,650 and stormwater and drainage trunk fee of $23,040 are established; <br /> <br />13. Final design for retaining walls will be required; <br />
