<br />15-3774 1700 Shoreline Drive <br />November 20, 2015 <br />Page 2 <br /> <br />A variety of topics have been discussed during Planning Commission and Council review of the <br />application. The attached draft Resolution attempts to address all relevant issues, including some <br />that have not received much discussion. It is possible that certain items may require additional <br />consideration if Council desires. To summarize the key elements of the Resolution: <br />- Physical characteristics of the property and the proposed development are documented; <br />- It is noted that a variance for road length is intended to be granted and justification for the <br />variance provided; <br />- Concerns of the Foxhill residents are noted in the ‘Findings’, and the Developer’s <br />remedies for addressing those concerns are noted in the Conclusions, Order and <br />Conditions; <br />- The Conservation Design inventory and Master Plan are summarized, with the condition <br />that the Conservation Design recommendations be adhered to; <br />- Provision of municipal sewer to the property is discussed; a Sewer Connection Charge of <br />$89,760 is established based on the 1998 Shoreline/Heritage Sewer project per the 2015 <br />Fee Schedule – this includes connection of the three new homes plus the exiting main <br />residence at 1700 Shoreline Drive; <br />- It is noted that Lots 1 and 2 will have new existing grades established for height and story <br />determination purposes; <br />- The three Outlots along Shoreline Drive intended as future potential dockage for Lots 1 <br />thru 3 are discussed, noting that this plat approval does not approve use of those outlots <br />for dockage, but requires separate City and MCWD review and approval <br />- The standard easements for wetland protection are required; the small wetland being <br />filled for the road extension technically requires approval by MCWD, is not expected to <br />require mitigation under the deminimus rules, and under Orono Code is required to be <br />removed from the Wetland Overlay District. This process would occur as part of final <br />plat approval; <br />- Removal of the existing cul-de-sac wings is to be decided prior to final plat approval; <br />- Minnehaha Creek Watershed District approval of the stormwater management plan and <br />facilities will be required in order to gain final plat approval; <br />- Recommendations of the City Engineer regarding stormwater management and other <br />topics shall be addressed and adhered to: <br />- Park Fee of $16,650 and Stormwater & Drainage Trunk Fee of $23,040 are established; <br />- Final design for retaining walls will be required (the extension of Heritage Lane through <br />the small wetland requires a retaining wall); <br />- Development Agreement and Letter of Credit will be required; <br />Staff Recommendation
