Page 2 of 3 <br /> <br />(3) Any other act or omission declared by law to be a public nuisance. <br />(b) It is unlawful for any person to permit real property under his control to be used to <br />maintain a public nuisance, or let the property to another knowing it is to be so used. <br /> <br />SECTION 3. Division 6 Performance standards, Section 78-1583 Glare or heat of <br />the City of Orono Municipal Code is hereby amended by adding the following text <br />Sec. 78-1573. – Glare or heat Lighting. <br />Any use requiring an operation producing an intense heat or light transmission shall be <br />performed with the necessary shielding to prevent such heat or light from being detectable at the <br />lot line of the site on which the use is located. Lighting in all instances shall be diffused or <br />directed away from R districts and public streets. <br /> <br />(a) General provision. Any lighting used to illuminate a structure, an off-street parking area, <br />or other area in any district in any residential zoning district shall be arranged so as to deflect <br />light away from any adjoining residential property or from any public right-of-way. All <br />lighting shall be installed in accordance with the following provisions: <br />(1) Lighting adjacent property. Lighting sources shall not be permitted so as to light <br />adjacent property in excess of the maximum intensity. <br />(2) Architectural/historical light fixtures. Architectural/historical light fixtures that <br />feature globes that are not shielded may be approved by the City Administrator or <br />designee. In no case shall the light affect adjacent property in excess of the maximum <br />intensity. <br />(3) Maximum Intensity. No light source or combination thereof which casts light on a <br />public street shall exceed one foot-candle (meter reading) as measured from the right-of- <br />way of said street nor shall any light source or combination thereof which casts light on <br />adjacent residential property exceed four-tenths (0.4) foot candles (meter reading) as <br />measured at the property line. <br />(4) Location. The light source of an outdoor light fixture shall be set back a minimum of <br />ten feet from a street right-of-way. Outdoor light fixtures, when placed within the lake <br />yard, shall be fully shielded. <br /> <br />SECTION 4. EFFECTIVE DATE: This ordinance shall take effect immediately upon <br />its passage and publication. <br />ADOPTED this ____day of ______________, 2015 on a vote of __ ayes and __ <br />nays by the City Council of Orono, Minnesota. <br /> <br />ATTEST: <br /> <br />
