Page 1 of 3 <br /> <br /> <br />ORDINANCE NO. ___, THIRD SERIES <br /> <br /> <br />CITY OF ORONO <br />HENNEPIN COUNTY, MINNESOTA <br /> <br />AN ORDINANCE AMENDING THE ORONO MUNICIPAL CODE <br />BY AMENDING SECTIONS 78-1, 70-4, and 78-1573 <br />REGARDING LIVING WALLS IN THE LAKE YARD AND LIGHTING IN <br />RESIDENTIAL ZONING DISTRICTS <br /> <br /> <br />THE CITY COUNCIL OF ORONO ORDAINS: <br /> <br />SECTION 1. Section 78-1 Definitions of the City of Orono Municipal Code is <br />hereby amended by adding the following text: <br />“Fully shielded luminaire means a luminaire constructed and installed in such a manner that all <br />light emitted by the luminaire, either directly from the lamp or a diffusing element, or indirectly <br />by reflection or refraction from any part of the luminaire, is projected below the horizontal plane <br />through the luminaire's lowest light-emitting part.” <br /> <br />“Glare means the sensation produced by one or more luminaires within the visual field that are <br />sufficiently greater than the luminance to which the eyes are adapted, which causes annoyance, <br />discomfort, or loss in visual performance and visibility. <br /> <br /> “Living Wall means a combination of evergreen plants that are 6ft in height and planted in such <br />a manner that their spacing is equal to the width of the plant.” <br /> <br />SECTION 2. Section 70-4 Public Nuisance of the City of Orono Municipal Code is <br />hereby amended by adding the following text” <br />(a) It is unlawful for any person to maintain a public nuisance by his act or failure to perform a <br />legal duty. For purposes of this section, a public nuisance shall be defined as any of the <br />following: <br />(1) Maintaining or permitting a condition which unreasonably annoys, injures or <br />endangers the safety, health, morals, comfort or repose of any considerable number of <br />members of the public, including, but not limited to: <br />a. Lighting which casts light on adjacent residential property that exceed four-tenths <br />(0.4) foot candles (meter reading) as measured at the property line for a period longer <br />than 2 hours. <br />b. The maintenance of a living wall within a required lake yard; <br />(2) Interfering with, obstructing or rendering dangerous for passage any street, public <br />right-of-way or waters used by the public; or <br /> a. Lighting that is aimed or directed to create glare within any street.
