OO CITY of ORONO <br /> m� RESOLUTION OF THE CITY COUNCIL <br /> NO. ` <br /> $EgHO <br /> 2. Applicants shall limit hardcover in the 75-250 foot zone to 25%. All existing and <br /> proposed hardcover approved with this variance application is recorded on the <br /> survey and hardcover calculation attached to this resolution as Exhibit A. The <br /> current owner and all future owners of this property are placed on notice that <br /> hardcover shall be maintained at the current levels, and any proposed <br /> improvements to this property that will result in additional hardcover must be <br /> approved by the City and such approval'may result in a requirement for <br /> concurrent equivalent or greater removals of existing hardcover. All existing <br /> hardcover scheduled for removal, as shown in Exhibit A must be removed prior <br /> to the footing inspection for the new construction. <br /> 3. As part of the building permit application, applicants shall provide a <br /> vegetation/screening plan for the area north of the westerly addition, such plan <br /> to provide a sufficient number and size.of plantings to yield a 70% opaqueness <br /> at full maturity to a height of at least 10 feet. These plantings shall be completed <br /> within 90 days of the date of final inspection of the additions, and failure to <br /> provide such plantings shall be considered a violation of the terms and conditions <br /> of this resolution. <br /> 4. Authorities granted by this variance run with the property not with the applicants, <br /> but are permissive only and must be exercised by application for a building <br /> permit within one year of the date of Council approval, or this variance will <br /> expire on that date (November 8, 1994). <br /> 5. Violation of or non-compliance with any of the terms and conditions of this <br /> resolution shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a misdemeanor. <br /> 6. The undersigned applicants have read, understood and hereby agree to the terms <br /> of this resolution and on behalf of themselves, their heirs, successors and assigns, <br /> hereby agree to the recording of this resolution in the chain of title of the <br /> property. <br /> Page 3 of 5 <br /> Form 5005 Disk Orono <br />
