O O CITY of ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> $EgII0 <br /> B. There is no other reasonable and feasible location for the addition meeting <br /> the code requirements, the hardship being the existing house location and <br /> the lot width in relation to the required side street and side yard setback. <br /> C. With appropriate vegetative screening and removal of an encroaching <br /> fence along the north side of the garage, the additions will have no <br /> detrimental impact on the neighborhood. <br /> 4. This application is a renewal of variances previously granted via Resolution#2852 <br /> (Application File #1566) on August 13, 1990. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicants and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> 6. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial property <br /> right of the applicants; and would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a variance to Municipal Zoning Code Section 10.24, Subdivision 5 (B) to permit the <br /> construction of a second story addition and westerly extending room addition to the existing <br /> residence, such additions being 6.5 feet from the side street lot line where a 35 foot side street <br /> setback is normally required, subject to the following conditions: <br /> 1.
