O <br /> � ��`� ;��"� RESOLUTION OF THE CITY COUNCIL <br /> � ...� <�: �, 3 3 � 0 <br /> '� ,i ��� ��, NO. <br /> ��9x O¢�G <br /> ESII <br /> A RESOLUTION GRANTING <br /> VARIANCES TO <br /> MUNICIPAL ZONING CODE <br /> SECTION 10.22, SUBDIVISIONS 1 (B) AND 2 <br /> FILE #1846 <br /> WHEREAS, Alan Upin and Leslee Upin(hereinafter "the applicants") are owners <br /> of the property located at 740 Tonkawa Road within the City of Orono (hereinafter "City") and <br /> legally described as follows: <br /> That part of Lot 10 lying Southeasterly of a line drawn through it equi-distant from the <br /> Northwesterly and Southeasterly lines thereof. Also the Northwesterly 25 feet measured <br /> � at right angles from the Northwesterly line thereof of Lot 11, "Parten's Point First <br /> Division", according to the recorded plat thereof, Hennepin County, Minnesota <br /> (hereinafter "the property"); and <br /> WHEREAS, the applicants have applied to the City for variances to Municipal <br /> Zoning Code Section 10.22, Subdivision 1 (B) to permit construction of a 12'x19' attached <br /> screen porch addition to the lakeside of the existing residence to be located 65' from the <br /> shoreline where a 75' setback is required and where a grade level patio exists at 60', said <br /> structure shall be located 5' in front of the average lakeshore setback line where no such <br /> � encroachment is allowed and where a grade level patio exists 10' in front of the setback line. <br /> Per Section 10.22, Subdivision 2 hardcover within the 0-75' setback area is proposed at 438 s.f. � <br /> or 7.7% where none is allowed and where 584 s.f. or 10.3% exists and in the 75-250' setback <br /> area hardcover is proposed at 4,610 s.f. or 45.2% where 25% is allowed and where 48% exists. <br /> NOW, THEREFORE, BE IT RE50LVED by the Ciry Council of Orono, <br /> Minnesota: � <br /> � FINDINGS <br /> 1. This application was reviewed as Zoning File #1846. <br /> 2. The�property is located in the LR-1B, Lakeshore Residential Zoning District <br /> requiring 1 acre in area.
