Barnes First <br /> Addition, in Section 10, Township 117, Range 23, according to <br /> � the recorded plat thereof on file and of record in the office of the <br /> Registrar of Titles, Hennepin County, Minnesota (hereinafter the <br /> • property); and <br /> WIi�REAS, on June 4, 1993 the applicant submitted a letter to the City <br /> requesting that his properry be allowed to connect to the municipal sewer which is located in the <br /> right-of-way of County Road 15 approximately 20 feet from his southeasterly property corner; <br /> and <br /> WHEREAS, said municipal sewer line is part of the City's 1985-LS-1 Crystal <br /> Bay sewer lateral project, for which properties bene�tting by such system were assessed for the <br /> costs of said system; and . <br /> WI�REAS, the properry at 1940 Shoreline Drive was not provided with a sewer <br /> stub as part of Project 1985-LS-1, it was not assessed for that project, and was not incorporated <br /> within the MUSA boundary created for said project; and <br /> WHEREAS, the applicant has made formal application to� the City for a <br /> Comprehensive Plan amendment to relocate the MUSA boundary to include his properry, which <br /> amendment was approved by the City Council in Resolution #3348 on October 25, 1993, and <br /> approved by the Metropolitan Council on November 4, 1993; and <br /> WHEREAS, the properiy is located on the °lakeshore of Lake Minnetonka and <br /> <. contains a single family residence with a failing septic system.
