' �� � �,: <br /> ,�, � �', :�-=� ti No. 3 3 �' '� - <br /> Y, � <br /> ���x, o4�G <br /> ESI; <br /> WHEREAS, Lot 2, containing an existing residence, is within the Metropolitan <br /> Urban Service Area (MUSA) and is provided with municipal sewer as part of the 1980-1 <br /> Minnetonka Bluffs Sewer Project. Lot 1, currently vacant, will not be served with municipal <br /> sewer, is outside the MUSA, and has been confirmed as having acceptable primary and alternate <br /> drainfield sites; and <br /> WI�REAS, a City designated wetland occurs within the properiy at two locations <br /> along the southeast border of the property. A Flowage and Conservation Easement has been <br /> granted to protect these wetlands; and <br /> WHEREAS, 33' of right-of-way for Orono Orchard Road has been dedicated <br /> within the plat. Additionally, a triangular portion of land has been dedicated on the plat as right- <br /> of-way for Orono Lane, adjacent to Outlot A; and <br /> WHEREAS, no additional right-of-way is required to be dedicated for Fox Street, <br /> • and no upgrade of the existing Fox Street roadway is required as part of the subdivision; and <br /> WHEREAS, it is the City's intent that Lot 2 shall continue to gain access from <br /> Fox Street, and that Lot 1 shall be allowed access either on Fox Street or Orono Orchard Road, <br /> but not from both roadways; and <br /> WHEREAS, it is the City's intent that Outlot A shall be maintained in common <br /> ownership with Lot 1 as residential lake access for Lot 1, subject to the Special Lot Combination <br /> Agreement which has been executed by the City and the subdivider and which will be filed on <br /> the Chain of Title of Lot 1 and Outlot A; and <br /> WI�REAS, Lot 1 has been demonstrated to contain suitable primary and <br /> altemate drainfield sites to serve a proposed single family residence, which can be constructed <br /> on Lot 1 without the need for additional variances; and <br /> WHEREAS, the subdivider has completed all requirements of the platting <br /> regulations of the City, including: <br /> 1. Completion of the requirements of Resolution No. 3224. <br /> 2. Dedication on the plat of rights-of-way for Orono Orchard Road and Orono Lane. <br /> ! <br /> • Page 2 of 4 <br /> .
