The filling and grading necessary to merely accommodate construction of <br /> a residence on the property is reasonable as long as the impacts of such <br /> grading are minunized to the greatest degree possible, both by house <br /> placement as well as by using appropriate erosion control methods. <br /> H. The removal of just those trees necessary to accommodate construction of <br /> a residence is fair and reasonable. <br /> I. Planning Commission recommends that the Council look favorably on any <br /> revised proposal which might result in up to a 10' encroachment into the <br /> � street setback zone but which therefore reduces the impacts on the steep <br /> slope and bluff impact zone by moving the proposed residence nearer the <br /> street. � � <br /> • J. Planning Commission recommends that the fill and retaining walls on the <br /> lakeside of the proposed residence be omitted, that the proposed deck be <br /> allowed, and that any patio area on the lakeside of the residence be � <br /> constructed as a deck to eluninate the need for filling. <br /> K. Planning Commission recommends that the applicants preserve existing <br /> vegetation to the greatest extent possible to preserve the existing degree <br /> of screening from Tanager Lake. <br /> I,. Planning Commission recommends that the tile drain system incorporate <br /> an underground percolation system to minimize erosion potential. <br /> M. The Minnesota DNR has submitted a letter of non-objection to the <br /> � variance subject to the following conditions: � <br /> 1) The design of the structure and bluff alterations must be reviewed <br /> and approved by a registered structural or soils engineer. This <br /> review must consider the stability of the structure and appropriate <br /> design to minunize erosion in the altered area during and after <br /> construction. . <br /> .
