______��,.�:_..-;,y,.- . -, ._.__"'_Y._ ___.�__._._-__.__�...._.�."'_"'_'___.___.'__"_�..�--__.__.�._._"..__..__'.._.�___._.__M____ <br /> .x � �,- <br /> _ � ��' CITY of ORONO <br /> O .,� O <br /> �� ���?e�=� RESOLUTION OF THE CITY COUNCIL <br /> r� � ' <br /> ,� '! �, �'.a,� �, N0. � L� � � <br /> Y, � � <br /> ���� o4�G <br /> Es8 <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE � <br /> SECTION 10.56, SUBDIVISION 16 (C), <br /> SECTION 10.56, SUBDIVISION 16 (n, <br /> SECTION 10.56, SUBDIVISION 16 (�, AND <br /> SECTION 10.23, SUBDIVISION 6 (B) <br /> FILE NO. 1909 <br /> WI�REAS, David and Margaret Vergeyle (hereinafter "the applicants") are <br /> owners of the property located at 1485 Green Trees Road within the City of Orono (hereinafter <br /> "City") and legally described as follows: <br /> Lot 1, Block 1, Green Trees on Tanager Lake, Hennepin County, Minnesota <br /> (hereinafter "the properry"); and <br /> ', WHEREAS, the applicants have applied to the City for variances to Municipal <br /> Zoning Code Section 10.56, Subdivision 16 (C) (2 & 3) to allow placement of a residence <br /> structure at a setback of less than the required 30' from the defined "top of bluff", and to allow <br /> placement of said structure within the bluff impact zone where structures and accessory facilities <br /> are not allowed; and for a variance to Section 10.56, Subdivision 16 (I) to allow intensive <br /> vegetation clearing on steep slopes to accommodate the proposed residence; and for a variance <br /> to Section 10.56, Subdivision 16 (� (5) (h) to allow fill placement in a bluff impact zone; and <br /> for a variance to Section 10.23, Subdivision 6 (B) to allow a front yard setback of 39.4' where <br /> a 50' front yard setback is normally required. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> l.
