Total lot area is 62,660 s.f. but only 19,210 s.f. lies within the 75-250' <br /> setback area. <br /> B. A standard lakeshore lot with 62,660 s.f. in area would have yielded much <br /> higher hardcover allowances within the 75-250' setback zone. <br /> C. The property is located on a pensinsula. <br /> D. The properly contains unique topographic constraints. <br /> E. The house has been designed to lunit horizontal expansion utilizing the <br /> building footprint to provide additional outdoor recreational space. <br /> F. Surface runoff from 20%+ of the total 29.2%of hardcover improvements <br /> will be treated within a drainfield area and will not run directly into lake. <br /> • G. The ma'or ortions of the roof structure will meet the allowed �0' legal <br /> J P <br /> height. A small obervation tower located within the central portion of the <br /> building will be at a 35' height. <br /> H. The majority of the structure will be located beneath the tree line of the <br /> property. <br /> 4. The City Council fmds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a f�re hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial property <br /> right of the applicants; and would be in keeping with the spirit and intent of the <br /> Zoni.ng Code and Comprehensive Plan of the City. � <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> . by the applicants and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> .
