The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to otlier property in this zoning district; that <br /> . granting the variances would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger� to neighboring property; would not merely <br /> serve as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial property <br /> right of the applicant; and would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> ' � recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicant and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> CONCLUSION5, ORDER AND C01�1DITIONS <br /> • Based upon one or more of.the findings noted above, the Orano City Council <br /> � hereby grants variances to Municipal Zoning Code Section 10.24, Subdivision 5 (B) to permit <br /> construction of a new residence on a property that does not meet the area or width requirements <br /> seeking approval of an 18,560 s.f. or 42.6% area variance and 40' or 28.5% lot width variance, <br /> subject to the following conditions: <br /> 1. The four properties shall be legally combined prior to the City's issuance of a <br /> building permit. <br /> 2. All future development shall be subject to the standards of the LR-1B Zoning <br /> District and Shoreland Regulations of the City. <br /> 3. Per Section 10.03, Subdivision 10, the lot is classified as a through lot and all <br /> accessory structures will require a conditional use permit. <br /> 4. Owner and future developer of progerty shall be responsible for installing a paved <br /> road within the right-of-way of Parlc Avenue at the same width as the eYisting <br /> paved road to the south. Owner shall also install a turnaround 'unprovement that � <br /> will allow municipal maintenance vehicles the ability to turnaround within the 30' <br /> wide right-of-way of Park Avenue and owner's private driveway as shown on <br /> Engineer's drawing included as Page 5 of this resolution.
