As already noted <br />above, Lot 1 meets all required lot standards. The division can be completed through a simple <br />Class I subdivision process. <br />The subdivision was reviewed at both the March 20, 1995 and September 18, 1995 meetings. <br />During the March 20th review, the applicant advised of his future intention to divide Lot 3 from <br />the homestead parcel, Lot 4. At that point, both the City staff and the Planning Commission <br />advised applicant of all Code and policy issues that may impact this property with the future <br />division. The applicant asked that the application be tabled allowing applicant additional time to <br />review the Code, to consider his legal rights as the property owner and to research the background <br />on the legal combination of the properties in 1967. He noted his request was based on the <br />convenience of receiving one tax statement. Cloutier noted he was never advised of the impact <br />of the legal combination on the properties and has always assumed that he had three potential <br />building sites. <br />Exhibits N -S document the many exchanges between the City Attorney, staff and applicant from <br />April through August.
