The property is unique based on the irregular or peninsula shape and the <br /> fact that a recent ordinance amendment has reclassified 6,444 s.f. of <br /> residence structure nonconforming requiring special consideration. <br /> 4. The City Council finds that the conditions existing on this properly are peculiar <br /> • to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or di�culty; is necessary to preserve a substantial <br /> property right of the applicant; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> • 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicants and the effect of the proposed variance on the health, safety <br /> and welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a variance to Municipal Zoning Code Section 10.56, Subdivision 16 (C) to permit <br /> construction of a family room addition granting a 62' or 41.3% setback variance and a three <br /> season porch addition granting a 64' or 42.6% setback variance, subject to the folluwing <br /> conditions: <br /> 1. Applicants shall file a lot line rearrangement of the shared lot line between Lots <br /> 2 and 3 so that detached garage shall be totally located within Lot 2 and that <br /> structure will meet required side yard setback of 10'. Applicants shall also <br /> obtain a penalty building permit for detached garage. <br /> 2. Authorities granted by this resolution run with the property not with the <br /> applicants, but are permissive only and must be exercised by application for a <br /> building permit within one�year of the date of Council approval, or this variance <br /> • v�rill expire on that date (March 11, 1997). <br /> Page 3 of 5 <br />
