Mabusth <br />Title Building & Zoning Administrator <br />DATE: June 21, 1995 <br />ITEM NO.: <br />Agenda Section: <br />Zoning <br />Item Description: #2023 Betty Sumner, 3131 Casco Circle -Variance -Resolution <br />Zoning District: LR-lC <br />Approximate area = 24,625 s.f. <br />Brief Review of Application <br />Applicant proposes the paving of 750.5 s.f. of an area that was originally installed with a plastic <br />underliner covered with rock and wood chips. Prior to the hardcover inventory, applicant had <br />removed all plastic underliners placed beneath existing landscape areas. Hardcover is at 42.9% <br />within the 75-250' setback area. Applicant was advised to file a hardcover variance application <br />to ensure that the non-structural hardcover improvement would be legal based on current code <br />requirements. Applicant was advised of the City's policy to require the removal of certain non- <br />structural hardcover improvements where excesses exist. <br />The applicant was also advised that the City will not require a permit for the paving <br />improvement. <br />The Planning Commission recommended unanimous approval of the application as proposed <br />based on the findings and hardships set forth in the enclosed staff memo of June 14, 1995. The <br />Planning Commission also reaffirmed staff's action in bringing the applicant before the City to <br />obtain approval for the paving improvements. <br />The enclosed resolution has been drafted per the Planning Commission's recommendation. <br />COUNCIL ACTION REQUESTED: <br />To either deny, ado~t or amend the enclosed approval resolution. If Council disagrees with <br />staff's actions to require applicant to submit a variance application, staff will refund the entire <br />fee payment. <br />ch
