RESOLUTION OF THE CITY COUNCIL . �kEsxo�' No. � 4 $ CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants variances to the Municipal Zoning Code Sections noted above that would permit the completion of the construction of an upper level deck and grants a structural coverage increase of 14.9 s.f. or 0.1%, and hardcover variance of 1,276.3 s.f. or 18.4% and a 21' encroachment of the average lakeshore setback line, subject to the following conditions: 1. Applicant shall obtain a penalTy building permit before proceeding with construction on unf'inished deck. Applicant to contact Building Official to determine what type of information will be needed to complete the filing of the building permit application. 2. Existing hardcover improvements consisting of 50.6 s.f. of lower level deck and • plastic underliner beneafli deck to be removed prior to the framing inspection by the Building Inspector. 3. Authorities granted by this resolution run with the property not with the � applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (August 12, 1997). 4. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the Chain of Title of the property. • Page 3 of 5
