° , <br /> .. _ . ._ l. : , <br /> - � . <br /> � O ' Y <br /> • O O <br /> ��b. - CITY of ORONO <br /> � � � � <br /> ti <br /> �� �,'�' RESOLUTION OF THE CITY COUNCIL <br /> � ��kESH�g'� NO. � '7 � �. •- <br /> A RESOLUTION APPROVING <br /> COMPREHENSIVE PLAN AMENDMENT #6 <br /> WI�REA.S, in June 1980, the City Council of the Ciry of Orono (hereinafter "the <br /> City") adopted a Community Management Plan (hereinafter "CMP") tc� provide for the orderly <br /> development of�the City. An integral part of the Plan provided that sewered areas of the City be <br /> included within the Metropolitan Urban Service Area (hereinafter "MUSA"); and <br /> WI�REAS, the MUSA boundary originally adopted via Resolution No. 1135 on <br /> April 14, 1980 was subsequently revised by Resolution No. 1337 on November 23, 1981; <br /> Resolution No. 2131 on February 23, 1987; Resolution No. 2437 on May 23, 1988; Resolution <br /> No. 3153 on August 10, 1992; Resolution No. 3283 on May 24, 1993; and Resolution No. 3348 <br /> on October 25, 1993; and <br /> • WHEREAS, on September 13, 1993, the City Council adopted Ordinance No. � <br /> 120, Second Series to establish a moratorium on the enforcement of City ordinances requiring <br /> upgrade of certain non-conforming septic systems determined to be non-conforming due solely <br /> to the lack of at least 3 feet of unsaturated soil or sand between the distribution device and the <br /> limiting soil characteristics. The intent of the moratorium was to allow the City to determine <br /> whether certain neighborhoods should be provided with municipal sewer rather than be forced to <br /> upgrade septic systems; and <br /> . WHEREAS, City staff subsequently completed a study which identified ten <br /> individual Orono neighborhoods where, due to various factors, it was determined that installation <br /> of municipal sewers may be preferable to long-term usage of on-site sewage treatment systems; <br /> and <br /> WHEREAS, on November 9, 1994, the City Council directed City staff to prepare <br /> an amendment to the CMP in order that the ten neighborhoods be incorporated within the MUSA; <br /> and <br /> WHEREAS, during preparation of the proposed amendment, it was concluded by <br /> the City Council that the Dillman property at 225 North Willow Drive and approximately 56 acies <br /> of Orono schools property on the west side of Old Crystal Bay Road (including a proposed ice <br /> arena site) should be incorporated into the amendment and added to the MUSA; and <br /> • <br /> Page 1 of 3 <br />
