RIDER TO PURCHASE AGREEMENT (Continued) <br />himself with the same. Seller makes no representation or <br />warranty as to soil conditions or other matters regarding <br />said premises not specifically set forth herein. Purchaser <br />shall have the right, from and after the date of this Purchase <br />Agreement, to enter upon said premises and conduct soil tests <br />thereon, all at Purchaser's own cost and expense. Purchaser <br />shall hold Seller and said land harmless from any and all <br />mechanic's and materialmen's liens resulting from activity <br />of Purchaser and/or Purchaser's engineers and/or surveyors <br />under the preceding sentence. In the event that Purchaser <br />determines that soil conditions on said premises are unsatis- <br />factory, in Purchaser's sole jud.;ment, Purchaser may elect to <br />terminate this Purchase Agreement by so notifying Seller of <br />such fast in writing by lette.- postmarked within _ days <br />of the date of this Purchase Agreement. In the event Purchaser <br />terminates this Purchase Agreement as aforesaid, all earnest <br />money paid hereunder shall be promptly refunded to Purchaser, <br />whereupon this Purchase Agreement shall become and be null and <br />void. <br />III. In the event Seller elects to proceed with the development of <br />said subdivision and this Purchase Agreement, Seller shall <br />proceed forthwith to develop said premises in accordance with <br />the conditions of development required by Orono: <br />A. Seller agrees, all at Seller's own cost and expense, <br />to substantially complete all things required of Seller <br />by Orono, including, without limitation, construction <br />of North Farm Road and West Farm Road as described below, <br />and the installation of public utilities (telephone, <br />electricity and qas only) in the North Farm Road anci <br />-2- <br />
