CITY of ORONO �� ,�, ;i,� a� RESOLUTION OF THE CITY COUNCIL ��k ESHO � NO. 3936 CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings,the Orono City Council hereby grants a conditional use permit, a side yard variance, and hardcover variance in the 0-75' and 75-250' lakeshore setback per Municipal Zoning Code Section 10.03, Subdivisi-II 19, Section 10.22, Subdivision 2, Section 10.24, Subdivision 5 and Section 10.09, Subdivision 5 to permit replacement of a timber retaining wall with a concrete block wall in the 0-75'lakeshore setback and to remove a timber walkway in the required north side yard and replace with a retaining wall, subject to the following conditions: 1. The retaining wall and walkway will be constructed as shown in Exhibits C and E. 2. Authorities granted by this resolution run with the property not with the owners, but are permissive only and must be exercised by application for a land alteration permit within one year of the date of Council's approval, or the special conditions of this resolution will expire on that date(July 28, 1998). 3. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the Zoning Code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the Chain of Title of the property.
